Full text of the release follows:

On Dec. 12, 2021, officers with Patrol Services charged 65-year-old Roger Mattioli with refusing to comply with a demand.

Around 6 p.m., officers responded to a call from EMS of a man in the driver’s seat of a vehicle, who is potentially impaired and may drive the vehicle away from the area.

Upon arrival in the Herkimer Street and Victoria Street area, officers developed grounds to believe the accused’s ability to operate a motor vehicle was impaired by alcohol.

Officers gave the accused several opportunities to provide a breath sample into an approved device, and he refused each time. He was arrested.

He is charged with refusing to comply with a demand.

He was released on an appearance notice and is scheduled to appear in court on Jan. 17, 2022.
