Man fined $2K for careless driving that caused Bruce Street crash

Originally charged with impaired driving, 61-year-old pleaded guilty to careless driving under the Highway Traffic Act in connection with collision on July 26, 2023

A motorist who fled a crash scene following a downtown collision in the summer was fined $2,000 Tuesday.

Terry Wallenius was behind the wheel of a 2019 black Chevy pickup that was involved in the July 26 noon-hour collision that occurred at the bottom of the Bruce Street hill at Grosvenor Avenue.

The 61-year-old accused was not in court, but his lawyer Anthony Orazietti, on his behalf, pleaded guilty to the Highway Traffic Act offence of careless driving.

Ontario Court Justice Heather Mendes heard Wallenius didn't stop and turned onto Lansdowne Avenue.

City police officers located his truck in the middle of that street, assistant Crown attorney Adrianna Mucciarelli said.

Wallenius was standing beside the vehicle.

Noting the odour of alcohol, the cops made a breath demand. Wallenius was taken to the station where he provided breath samples.

The court didn't hear about the results of the breathalyzer tests.

Mucciarelli said the Crown was relying on the facts about the collision.

Orazietti said he wanted to qualify one small detail.

His client pulled off onto Lansdowne because "Bruce Street was very busy," he told Mendes, adding "that's why the Crown is not proceeding with a failing to remain" at the scene charge.

The judge accepted the lawyers' joint sentencing submission for the $2,000 monetary penalty.

She gave Wallenius 12 months to pay the fine, and at the request of the prosecution withdrew other charges stemming from the incident.
