Traffic complaint leads to impaired driving charges

Accused is scheduled to appear in court on July 11

The Batchewana First Nation Police Service have charged a man with impaired driving after responding to a traffic complaint on June 10.

The incident occurred on Frontenac Street in the community of Batchewana First Nation, a news release stated. 

Full  text of the release follows:

On June 10, 2022 shortly after 7:30 p.m., members from the Batchewana First Nation Police Service responded to a traffic complaint of a possible impaired driver on Frontenac Street in the community of Batchewana First Nation. 

A short time later police located the suspect and while speaking to the driver police determined alcohol was consumed. The driver was arrested and transported to Sault Ste. Marie detachment for further testing. While at the detachment the driver refused to provide a breath sample.

As a result, Brandon Peck, 34 years of age from Sault Ste Marie, was charged with:

  • Failure or Refusal to Comply Demand, contrary to section 320.15(1) of the Criminal Code (CC)
  • Operation While Impaired-Alcohol and Drugs, contrary to section 320.14(a) of the CC
  • Driving While Under Suspension, contrary to section 53(1) of the Highway Traffic Act
  • Having Care and Control of a Motor Vehicle with Open Liquor, contrary to section Liquor Licence and Control Act.

The accused is scheduled to appear before the Ontario Court of Justice in Sault Ste Marie on July 11, 2022. The accused was issued a 90-day Administration Drivers Licence Suspension (ADLS), and the vehicle was impounded for seven days.
