MANITOULIN MAN COMMITTED TO STAND TRIAL ON FIRST DEGREE MURDER

Zhiibaahaasing First Nation, Manitoulin Island, Ont.

Members of the United Chiefs and Council of Manitoulin Anishnaabe Police Service, the Manitoulin Ontario Provincial Police and the OPP Northeast Region Crime Unit, under the direction of Detective Inspector Larry Reesor, Criminal Investigation Branch, OPP General Headquarters, conducted the investigation into the circumstances surrounding the death of a woman whose body was found at a Zhiibaahaasing First Nation residence on Manitoulin Island early Sunday morning on the 27th November 2005. Upon arriving at the residence the female occupant was found deceased. She was identified as 25-year-old Mary Ann Davis, of 340 Sagon Road, Zhiibaahaasing First Nation cause of death was determined to be from a gunshot wound. Her common law spouse Brent Jeremy KELLS age 21 of 304 Sagon Road, Zhibaahaasing First Nation was charged with First Degree Murder.

Mr. Kells appeared in Gore Bay Ontario Court of Justice from the 14th to the 17th November 2006 for a Preliminary Hearing. At the end of the Preliminary hearing the sitting justice reserved her decision until 29 November 2006. On Thursday the 29th November 2006 Justice SERRE rendered her decision, committing Mr. Kells to stand trial for First Degree Murder. Mr. Kells elected to be tried by a Judge and a Jury. Mr. Kells remains in custody pending trial.


HERE’S HOW OUR R.I.D.E CHECKS PANNED OUT

Sault Ste Marie, Ont.

Officers with the Sault Ste Marie OPP Detachment and members of the OPP Traffic and Marine Unit conducted five R.I.D.E. checks at different locations throughout our detachment area.

One hundred and fifteen vehicles were checked and so far no one was found to be drinking and driving. Seven people were given warnings for Highway Traffic Act violations.

Festive R.I.D.E. checks will continue every day at different locations in our detachment area.

NOTHING OUT OF THE ORDINARY

Sault Ste Marie, Ont.,

The men and women at the Sault Ste Marie OPP detachment had another routine 24 hours of law enforcement activities.

Officers responded to complaints involving animals, excessive noise, neighbour disputes and suspicious people and vehicles.

At about 11:00 p.m. officers were called to two separate homes on Hwy 17 in Laird Township. A male, under the influence of alcohol, had knocked on the door of the two homes looking for a ride to Sault Ste Marie. Police located the man and he was given transportation to a treatment center in Sault Ste Marie.

PATIENT CHARGED BY POLICE

(Elliot Lake, Ont.) The East Algoma OPP has charged a female with several charges after attending the local hospital regarding a disturbance. On November 28th, 2006 police were called to attended the hospital regarding a patient becoming upset with staff.

Charged with Assault with a Weapon X2 and Breach of Probation is Dara Louise JUDD (53) of Elliot Lake. JUDD is held in custody and awaiting a bail hearing.

TRAFFIC STOP LEAD TO DRUG CHARGES

(Elliot Lake, Ont.) In the early morning of November 29, 2006 at approximately 4:31 a.m. officers on patrol observed a vehicle on highway 108 being operated at slow speed. Traffic stop revealed a male driver being the sole occupant of the vehicle. Investigation resulted in the following charges.

Charged with Possession of Cannabis and Possession of Property Obtained by Crime is Oscar Fernando MENDOZA-HERNANDEZ (26) of Elliot Lake. MENDOZA- HERNANDEZ is scheduled to appear in court on January 2nd, 2007.

PERSONATION CHARGES AFTER ROUTINE TRAFFIC STOP

(Elliot Lake, Ont.) While on general patrol, on November 29th, 2006 police stopped a vehicle on Mississauga Avenue in Elliot Lake. Officers requesting vehicle information and a drivers license from the driver. The personal information given to the officer by driver was later, through investigation found to be false.

Charged with Personation with Intent and Obstruct Police is Shannon Charles POYNTER (32) of Elliot Lake. POYNTER is being held in custody pending a bail hearing.

THEFT UNDER CHARGES FOR LOCAL FEMALE

(Elliot Lake, Ont.) On November 28th, 2006 at approximately 2:50 p.m. police were called to attend a local grocery in regards to a possible theft.

On scene police were advised that the suspect had allegedly taken items and left the store without paying.

The East Algoma OPP have charged Roberta OBRIEN (24) of Elliot Lake with Theft Under. OBRIEN is scheduled to attend court on January 2, 2007.
